US Crypto Regulation in 2026: GENIUS Act and CLARITY Status

As of 27 September 2026, the GENIUS Act is enacted, with a broad effective date set as the earlier of 18 months after 18 July 2025 or 120 days after federal regulators issue implementing final rules. The CLARITY Act passed the House, but the Senate rejected cloture on the motion to proceed on 15 September 2026 by 49–50. That procedural vote did not enact or finally defeat the bill.

What changed by September 2026?

Congress enacted the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act on 18 July 2025. Enactment and the law's broad effective date are different milestones. Separately, the House passed the Digital Asset Market Clarity (CLARITY) Act, H.R. 3633, but the Senate's first September 2026 floor test failed. Readers should not treat a proposed rule, a House bill or a procedural Senate vote as a live nationwide authorization.

The Senate's official vote 234 records 49 yeas and 50 nays on 15 September 2026. It rejected cloture on a motion to proceed, which would have limited debate on whether to take up CLARITY. It was neither a final vote on the text nor presidential approval. Our canonical vote report tracks that outcome and later developments.

GENIUS Act: enacted law versus implementation

Section 20 of the enacted GENIUS Act sets its broad effective date as the earlier of 18 months after 18 July 2025 or 120 days after the primary federal payment stablecoin regulators issue any final implementing regulations. The 18-month date is 18 January 2027. Check the relevant regulator's final-rule notices before assuming the 120-day trigger has occurred. The OCC's March 2026 publication and the FDIC's April 2026 board action concerned proposed rules, not proof that every implementation obligation was already effective.

The statute addresses permitted payment stablecoin issuers, eligible reserves, redemption, oversight and disclosures. A bank-like reserve rule does not turn a stablecoin into an insured bank deposit. Our GENIUS Act explainer covers the implementation timeline, while the stablecoin risk guide explains issuer, reserve and redemption risk. This page does not certify that any named token or issuer satisfies the Act.

CLARITY Act: what the failed vote means

H.R. 3633 proposes a federal market-structure framework for digital assets, including how some activities would be divided between the SEC and CFTC. The Senate did not vote on final passage on 15 September. Because cloture failed, the chamber did not move forward on that schedule. The bill could return through a later procedural agreement or revised text, but no future vote or enactment is guaranteed.

Even Senate passage of identical text would require presentment to the president; changed text would require both chambers to agree. Until the legislative process is complete, bill language is a proposal rather than operative law. The Senate roll call is the primary record for the September result, and our vote explainer separates the vote from possible next steps.

What users and builders should verify

For a stablecoin, identify the legal issuer, the redemption counterparty, reserve reports, jurisdiction and current regulator notices. Do not infer deposit insurance, guaranteed redemption or statutory compliance from a token name, a proposed rule or a protocol listing. For a DeFi application, check the activity and entity actually regulated; the current CLARITY bill is not a blanket approval for a protocol.

Regulatory announcements can change access, custody and counterparty risk without changing a smart contract. Read the primary agency or legislative record and its event date, then compare it with the site's own updated date. The DeFi due-diligence checklist provides a practical framework; this article is educational and not legal advice.

Sources and update record

Original publication: 26 April 2026. Material accuracy update: 27 September 2026. The enacted statute supplies the GENIUS effective-date formula; the OCC proposed rule and FDIC meeting record show implementation work; the Senate vote record supplies the CLARITY outcome. This update corrects the earlier description of GENIUS as fully in effect and CLARITY as still advancing to its September floor test.
